These terms govern bookings made with Gonzo Media LLC ("Gonzo Media," "we," "us") through gonzo.media. Booking a shoot or paying a deposit means you accept them. Please read the cancellation and deposit sections carefully.
Booking & Deposit
A shoot is confirmed when the deposit is paid, not when a date is discussed. Until the deposit clears, the date remains available to other clients.
Unless a quote states otherwise, the deposit is 50% of the project total. Some quotes are issued payable in full up front; the amount due is always shown before you pay.
Deposits are non-refundable if you cancel within 24 hours of the scheduled shoot. Cancel with more than 24 hours' notice and the deposit is refunded in full, or applied to a rescheduled date, whichever you prefer.
Balance
The remaining balance is due on delivery of the finished files. We send a payment link when the work is ready. Final files are released once the balance clears.
Rescheduling
You may reschedule at no cost with more than 24 hours' notice, subject to availability. Inside 24 hours, rescheduling is treated as a cancellation and the deposit is forfeited.
Weather
Drone flights are governed by FAA rules and are not possible in rain, high wind, or low visibility. If conditions prevent safe or usable aerial work, we will reschedule the aerial portion at no charge. A weather reschedule initiated by us is never treated as a client cancellation, and your deposit stays intact.
Property Access
You are responsible for making sure the property is accessible, staged, and ready at the scheduled time. If we arrive and cannot shoot — no access, the property is not ready, or occupants are present and unwilling — the visit counts as a cancellation inside 24 hours.
For aerial work, you confirm that you have the right to authorize photography of the property. We will not fly where FAA airspace restrictions prohibit it.
Delivery
Standard delivery is within 48 hours of the shoot for photography, and within 72 hours where video or a 3D tour is included, unless the quote states otherwise. Rush delivery is available as a paid add-on. Delivery timelines run from the shoot date, not the booking date.
Revisions
Each project includes one round of reasonable revisions to the edited selects. Reshoots, additional editing rounds, or changes in scope after delivery are quoted separately.
Licensing & Copyright
Gonzo Media retains copyright in all images and video we produce. On full payment, you receive an unlimited, perpetual license to use the delivered files to market the specific property or business the shoot was booked for. This includes MLS listings, your website, social media, print materials, and brokerage marketing.
The license does not permit resale of the files, licensing them to third parties, or use by another agent or brokerage not party to the original booking. Please do not crop out or alter watermarks where they appear on preview files.
We may use delivered work in our own portfolio and marketing. If a property or client is sensitive and you would rather we did not, tell us and we will respect that.
Payments
Payments are processed by Stripe. We do not store card details. Prices are in U.S. dollars. Chargebacks filed without first contacting us to resolve the issue may result in recovery of the disputed amount plus associated fees.
Limitation of Liability
Our total liability for any claim arising from a project is limited to the amount you paid for that project. We are not liable for indirect or consequential losses, including lost sales or lost listings. This does not limit liability that cannot be limited under applicable law.
Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be brought in the state or federal courts located in Massachusetts.
Changes
We may update these terms. The version in effect when you booked is the one that applies to that booking.
